1. Introduction:

• Welcome to Motorpark (“Company”, “we”, “our”, “us”). This Terms of Service Agreement (the “Agreement”) governs your use of this website, www.motorpark.in  (the “Website”). Our Privacy Policy also governs your use of our Service & purchase of products and explains how we collect, safeguard and disclose information that results from your use of our web pages.

  Motorpark offers Services & products for purchase on this Website, or your purchase of services & products available on this Website. This Agreement includes and incorporates by this reference, the policies and guidelines referenced below, which shall part and parcel and operative of this Agreement. Motorpark reserves the right to change or revise the terms and conditions of this Agreement at any time by posting any changes or a revised Agreement on this Website. Motorpark will alert you that changes or revisions have been made by indicating on the top of this Agreement the date it was last revised. The changed or revised Agreement will be effective immediately after it is posted on this Website. Your use of the Website following the posting of any such changes or of a revised Agreement will constitute your irrevocable acceptance of any such changes or revisions. Motorpark encourages you to review this Agreement whenever you visit the Website to make sure that you fully understand the terms and conditions governing the use of the Website. This Agreement does not alter in any way the terms or conditions of any other written agreement you may have with Motorpark for other products or services. If you do not agree to this Agreement (including any referenced policies or guidelines), please immediately terminate your use of the Website, but please let us know by emailing at support@motorpark.com , so we can try to find a solution. These Terms apply to all visitors, users and others, who wish to access or use Service & products.

2. Communications:

• By using/purchasing our Service or products, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send in present or future. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing at support@motorpark.com.

3. Account creation & more:

• While creating an account with Motorpark, you will be required to provide certain information like Name, email id, mobile number and address.
• By creating an account or signing up for our website, you agree to be bound by these terms and conditions.
• You must be at least 18 years old to create an account or sign up on our website.
• You agree to provide accurate and complete information, when creating your account or signing up for our website. failure in doing so can result inability to make use of our full service.
• You are responsible for maintaining the confidentiality of your account information, including your username and password.
• You agree to immediately notify us of any unauthorized use of your account or any other breach of security.
• In case of any unacceptable activity, we reserve the right to refuse or cancel any account or sign up, without any prior notice.
• Users above 45+ years of age have to provide fitness certificate to motor training schools (depending on school policies and local rules and regulations in force).

4. Content:

• Content found on or through this website and other social media platforms are the property of Motorpark or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us.
• Pictures, contents or videos etc., on our website are for illustrative purposes only and Motorpark does not promote or subscribe to any activity/activities that are dangerous or can damage oneself or public at large.
• User are requested not try or imitate any kind of stunts, poses, or perform any reckless actions that pose serious harm to you and public at large.

5. Use of the website:

• You must be an Indian resident with legal age as per Indian law i.e., you need to be +18 years of age to make use of our services. The company at any point may ask for valid age and Indian residence proof, if required.
• You may not use our website for any illegal or unauthorized purposes.
• You may not attempt to access any restricted areas (If any) of our website.
• In case of unauthorised activity from your account, we reserve the right to terminate your access to our website at any time, without any further notice and without assigning any reason therefor.

6. Services:

• You are aware that Motorpark is an Ecommerce & online aggregator platform, were we enable you to view, find and compare offerings from multiple service & product providers under one platform.
• Services on our Platform lets you view and also book courses as per your requirement with individual and independent third-party motor training schools & Freelancers (Service professionals).
• You acknowledge and agree that any services provided by us through our website are provided on an “as is” basis and we make no representations or warranties, express or implied, regarding the quality, reliability, or availability of such services.
• We reserve the right to modify, suspend, or discontinue any aspect of the platform provided services at any time without any further notice.
• We are not responsible for quality of services offered by third-party/parties.
• Motorpark platforms are for personal and non-commercial use only, unless you have a business contract with Motorpark.
• Motorpark is currently not a motor training institute and does not conduct any driving test and or provide Drivers Licence /learners licence etc.
• Also, for the current moment we do not have the required or efficient instruments for disabled or handicap customers, but if any such requirements arise in present or future you can contact Motorpark directly to check if some adjustments can be considered at the required time, place or situation.
• Our website specifies all the required details regarding the service i.e., driving school & Freelancer name, location, pictures, fees and additional required information, etc. (All this information provided by respected driving schools and freelancers). Customers/users are shown this information before booking or making the payment, once Customer/user books and proceeds with the payment it is understood that customers/users have read and agreed to all the information prior to booking the service.
• You acknowledge and understand that training prices/fees and booking amount may differ from place to place, as it depends on various factors e.g., Area, petrol/diesel price, vehicle, individual schools & freelancers etc.
• Booking amount is non-refundable.
• To reserve a slot of training program a particular booking amount has to be paid and the balance fees has to be paid on the first day of training program.
• Training duration may differ for each course and service providers respectively.
• Motorpark is not responsible in case of injury or any unfortunate event during the training sessions.
• We may add or discontinue any service on our platform and the same will be update on respective platforms
• The company is not liable for any delay in training, driving school/ freelancer services, this is the sole responsibility of Driving Schools /freelancer and not Motorpark.

7.Products:

• You acknowledge that Motorpark is an Ecommerce & online aggregator platform, where we enable you to view, find, and compare offerings from multiple product providers under one platform.
• Products on our platform allow you to view and purchase various offerings.
• You acknowledge and agree that any products provided by us through our website are offered on an “as is” basis, and we make no representations or warranties, express or implied, regarding the quality, reliability, or availability of such products.
• We reserve the right to modify, suspend, or discontinue any aspect of the platform-provided products at any time without any further notice.
• We are not responsible for the quality of products offered.
• Motorpark platforms are for personal and non-commercial use only unless you have a business contract with Motorpark.
• Motorpark is currently not a manufacturer or producer of any of the products listed.
• Our website specifies all the required details regarding the product, including vendor name, location, delivery fees, pictures, pricing, and other necessary information. Customers/users are shown this information before purchasing, and once a customer/user proceeds with payment, it is understood that they have read and agreed to all information prior to making the purchase.
• You acknowledge and understand that product prices and availability may differ due to various factors such as location, vendor policies, etc.
• Product availability and delivery timelines may vary depending on the delivery location, third-party delivery partner, weather conditions, or any other unforeseen circumstances.
• We may add or discontinue any product listings on our platform, and the changes will be updated accordingly on the respective platform.

8. Mock RTO Test:

• The mock RTO test available on the Motorpark platform is for practice purposes only and does not serve as an official test.
• The results of the mock test are not recognized by any official RTO (Regional Transport Office) or any government authority.
• Participating in the mock test does not guarantee passing the official RTO test or obtaining a driving license.
• Motorpark is not liable for any consequences or decisions based on the mock test results.
• The content of the mock test is intended to help users prepare for the official RTO test; however, we do not guarantee the accuracy or completeness of the material.
• Users are responsible for verifying official RTO requirements and preparing accordingly.

9. Blog Page:

• The blog page on the Motorpark platform provides news, articles, images, videos, and other content related to the automotive sector.
• The content posted on the blog is for informational and educational purposes only. Motorpark does not guarantee the accuracy, completeness, or reliability of the information provided.
• All content, including articles, images, and videos, is the intellectual property of Motorpark or the respective content creators and may not be reproduced, distributed, or used without proper permission.
• The opinions expressed in blog posts are those of the authors and do not necessarily reflect the views of Motorpark.
• Motorpark reserves the right to modify or remove any content on the blog without prior notice.
• Any comments or feedback provided by users on the blog must adhere to our community guidelines. Offensive, abusive, or inappropriate comments will be removed at Motorpark’s discretion.
• Users are advised to verify any product or industry-related information directly from official sources before making any decisions based on the blog content.
• Motorpark is not liable for any direct or indirect damages resulting from the use of or reliance on content posted on the blog.

10. Purchase of our services & products:

• If you wish to purchase our service &/or products made available through our website, you may be asked to supply certain information relevant to your purchase including but not limited to, your UPI, credit or debit card numbers, the expiration date of your card, your billing address etc.
• You represent and warrant that: (i) you have the legal right to use any card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.
• We may employ the use of third-party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties, subject to our Privacy Policy.
• We reserve the right to refuse or cancel your order at any time, for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.
• As per our company policy, a product & service cannot be purchased together.

11. Training Program Refund Policy:

• If user cancels the slot after booking, the booking amount will not be refunded.
• User will not be eligible for a refund of booking amount once the course begins, although refund of course fees is subject to driving schools and freelancers refund policy.
• As per rules and regulations of Certain driving schools and freelancers “No refund” of course fees will be provided if booking is cancelled.
• In any extreme situation If you want to cancel your booking you may contact Motorpark directly, this will be subject to NO REFUND POLICY.
• Once course begins user cannot Cancel and/or Re-schedule booking on our website.
• Rescheduling, exchanging, or swapping a training program with other products or services on the website is not allowed.

12. Product Refund, Return & Exchange Policy:

Refund:

• Requests for refunds must be made within 3 days of receiving the product.
• To be eligible for a refund, the product must be unused, in its original packaging, and accompanied by proof of purchase tag & invoice.
• Certain products may be exempt from refunds, kindly check the same while purchasing the product in description or listing page.
• Refunds will be processed using the original payment method within 14 business working days of receiving the returned product.
• To initiate a refund, please contact our customer service team on WhatsApp with your order details and the reason for the refund.
• Once the product is received our team will arrange for Quality Check (QC) & review all your details, once it is approved we will initiate the refund process.
• Return shipping costs are the responsibility of the customer, except in cases of defective or incorrect items.

Exchange:

• Exchanges are allowed within 3 days of receiving the product, provided that the item is unused and in its original packaging and accompanied by proof of purchase tag & invoice.
• To initiate an exchange, please contact our customer service team on WhatsApp with your order details and the reason for the exchange. Once the product is received our team will arrange for Quality Check (QC) & review all your details, once it is approved we will initiate the exchange process.
• Any difference in price will be adjusted during the exchange process. If the new product is of a higher value, the customer will be responsible for paying the difference. If the new product is of a lower value, the balance amount will be settled into customers bank account by motorpark.
• Exchanges are subject to the availability of the new product or size requested.
• Certain products may be exempt from Exchange, kindly check the same while purchasing the product in description or listing page.
• Return shipping costs are the responsibility of the customer, except in cases of defective or incorrect items.

Damaged or Defective Products:

• If you receive a damaged or defective product, please contact us immediately for a replacement or refund.
• Evidence of the damage (photos) may be required to process your claim along with its original packaging and accompanied by proof of purchase tag & invoice.

13. License:

• Subject to your acceptance/ adherence to our terms and conditions, We, Motorpark grant you the limited access to use our Products & Services through website for personal use and not commercial use, unless of a business contract with Motorpark.
• Any rights not mentioned here are not granted and are reserved by Motorpark.

14. Intellectual Property:

• All content on our website and social media accounts, including text, graphics, logos, images, and software, is the property of our company or our licensors.
• All Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of motorpark and its licensors
• You may not use our content without our express written permission.
• You may not reproduce, modify, distribute, or display our content without our express written permission.

15. Analytics:

• We may use third-party Service Providers to monitor and analyse the use of our website.

16. No Use by Minors:

• Service is intended only for access and use by individuals at least eighteen (18) years old. By accessing or using Service, you warrant and represent that you are at least eighteen (18) years of age and with the full authority, right, and capacity to enter into this agreement and abide by all of the terms and conditions of Terms. If you are not at least eighteen (18) years old, you are prohibited from both the access and usage of Service.

• You may be held accountable for damages (including costs and attorneys’ fees) for misrepresentation or bad-faith claims on the infringement of any Content found on and/or through Service on your copyright.

18. Offers & Promotions:

• From time to time, we may have offers and Promotions on our website or social media platforms. Each Promotion and offer will have its own specific terms and conditions, which will be clearly stated on our website or social media platforms. By participating in a Promotion or offers you agree to be bound by its specific terms and conditions.
• Each Promotion and offers will have specific eligibility requirements, which will be clearly stated. In order to participate in a Promotion, or avail our offers you must meet all of the eligibility requirements. We reserve the right to disqualify any participant who does not meet the eligibility requirements or who violates any of these Terms.
• Any kind of offers or discounts promoted by Motorpark on social media platforms, website need to be claimed with Motorpark itself.
• Validity, eligibility, requirements will be subject to offers and promotions.

19. Contests, Coupons and Promotions:

• Any contests, Coupons or promotions (collectively, “Promotions”) made available through Motorpark may be governed by rules that are separate from these Terms of Service. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms of Service, Promotion rules will apply.

20. User generated content:

• Our website allow user to only post review and comment, posting any other form of content on our website is currently not possible.
• However, we provide the opportunity to users to create, submit & post content that contains image, videos, text, suggestions, or other materials on third party platforms that Motorpark is present on like Instagram, Facebook etc.
• User generated content is sole responsibility of user.
